Terms of Service for Chalet Haliburton

1. Agreement to Terms

These Terms of Service (the “Terms”) constitute a legally binding agreement between you (“Guest,” “you,” or “your”) and Chalet Haliburton (“we,” “us,” or “our”) regarding your use of the website https://chalet-haliburton.com and your booking of our property. By booking a stay with us, you agree to comply with these Terms.

2. Booking and Eligibility

  • Age Requirement: You must be at least 25 years old to book this property. The primary guest must be present during the entire stay.
  • Guest Verification: We reserve the right to request a valid government-issued ID to verify your age and identity before confirming your booking.
  • Occupancy Limits: The maximum occupancy is 6 guests (including children). Day visitors are not permitted without prior written approval. Unregistered guests will result in immediate termination of the booking without refund.

3. Check-In and Check-Out

  • Check-In: 4:00 PM – 11:00 PM.
  • Check-Out: Strictly by 10:00 AM to allow our cleaning team to prepare for the next guests.
  • Late Check-Out: Late check-outs may be available upon request but are subject to availability and potential fees.

4. House Rules

To ensure a peaceful stay for you and our neighbors, strict adherence to these rules is required:

A. Quiet Hours

Quiet hours are enforced from 11:00 PM to 8:00 AM. Please respect the noise regulations of the Municipality of Dysart et al. Excessive noise complaints may result in fines or eviction.

B. Garbage & Recycling

  • Guest Responsibility: Guests are responsible for removing all garbage and recycling at the end of their stay.
  • Disposal Location: Waste must be taken to the Haliburton Landfill (approximately 8 minutes away).
  • Penalty: Garbage left behind will incur a fee of $25.00 CAD per bag charged to your security deposit or credit card.

C. Smoking Policy

Smoking or vaping of any kind is strictly prohibited inside the chalet. Smoking is permitted outside, provided you properly dispose of butts. Evidence of smoking indoors will result in a cleaning fee of $500.00 CAD.

D. Pets

  • Approval Required: Pets are welcome only with pre-approval. You must disclose pets at the time of booking.

  • Responsibility: Owners are responsible for cleaning up after their pets. Any damage caused by pets will be charged to the guest.

5. Safety & Winter Access

  • Winter Driving: During winter months, the driveway is plowed but can be hilly. Winter tires and an AWD/4WD SUV are strongly recommended. We are not responsible for vehicles getting stuck due to lack of proper equipment.

  • Amenities: Use of the hot tub, sauna, and fire pit is at your own risk. Children must be supervised at all times. Glassware is not permitted in the hot tub area.

6. Cancellations and Refunds

  • Force Majeure: We are not liable for cancellations due to events beyond our control (e.g., extreme weather, power outages, road closures), but we will make reasonable efforts to reschedule your stay.

  • Responsibility: You are responsible for any damage to the property, furniture, or amenities caused by you or your party during your stay.
  • Reporting: Please report any accidental damage immediately so we can assess it fairly.
  • Charges: We reserve the right to charge your credit card for any damages, missing items, or excessive cleaning required after your departure.

8. Limitation of Liability

To the maximum extent permitted by law, Chalet Haliburton shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your stay, including but not limited to personal injury, loss of personal property, or accidents occurring on the premises.

9. Governing Law

These Terms shall be governed by and defined following the laws of the Province of Ontario and the laws of Canada. Any dispute arising in relation to these Terms shall be subject to the exclusive jurisdiction of the courts in Ontario.
